STANISSED TERMS AND CONDITIONS

GENERAL INFORMATION
These Terms and Conditions govern the use of the STANISSED online store available at www.stanissed.art and all purchases made through the website.
The online store is operated by:

These Terms and Conditions are governed by Polish law and applicable European Union consumer protection legislation.
DEFINITIONS
Store – the online store available at www.stanissed.art.
Seller – BARTOSZ RUSIN TECNOFABS.
Customer – any natural person, legal entity or organization placing an order through the Store.
Consumer – a natural person acting for purposes outside their trade, business or profession.
Consumer Rights also apply, where required by Polish law, to natural persons entering into agreements directly related to their business activity when the agreement does not have a professional character for that person.
Goods – products offered for sale through the Store.
Order – a purchase request submitted by the Customer through the Store.
Services – all services provided electronically through the Store.
ELIGIBILITY AND USE OF THE STORE
Customers may browse the Store and place orders either through a customer account or, where available, as a guest.
The Customer agrees to provide accurate and complete information when placing orders or creating an account.
The Customer is responsible for maintaining the confidentiality of account credentials and for all activities performed through their account.
The Store may suspend or terminate access in cases of fraud, abuse, unlawful activity, or violations of these Terms.
PRODUCTS
We make every reasonable effort to accurately display product descriptions, images, dimensions and specifications.
Due to differences in device displays and the handcrafted nature of certain products, actual products may vary slightly from photographs or descriptions.
Minor variations in dimensions, color, texture or finish shall not constitute a defect.
Products must be used only for their intended purpose.
PRICES
All prices displayed on the Store are gross prices and include applicable VAT where required by law.
Shipping costs are displayed separately during checkout before the Customer places an order.
The total order value, including shipping charges and applicable taxes, is displayed before the Customer completes the purchase.
ORDERS
Submitting an order constitutes an offer to purchase Goods.
The sales contract is concluded when the Seller accepts the order and sends an order confirmation by email.
The Seller reserves the right to refuse or cancel an order in cases including:
• suspected fraud;
• pricing errors;
• product unavailability;
• violation of these Terms.
If payment has already been collected for a cancelled order, a full refund will be issued.
ORDER CANCELLATIONS
Customers may request to cancel an order at any time before it has been fulfilled.
Cancellation requests may be submitted through the cancellation functionality available in the customer account, through links provided in order-related communications where available, or by contacting us at contact@stanissed.art.
Once an order has been fulfilled or shipped, it can no longer be cancelled. Customers located in the European Union may then exercise their statutory right of withdrawal in accordance with the "Right of Withdrawal (EU Consumers)" section of these Terms.
If an order is successfully cancelled before fulfillment, any payment received will be refunded using the original payment method as soon as reasonably possible.
PAYMENT
The Store accepts payment methods made available during checkout, including but not limited to:
• BLIK;
• PayPal;
• Klarna;
• debit cards;
• credit cards.
Payment must be successfully authorized before the order is processed.
SHIPPING AND DELIVERY
Orders are shipped from Poland.
Estimated delivery times are provided for information purposes only and do not constitute guaranteed delivery dates.
The Seller is not responsible for delays caused by customs authorities, carriers, force majeure events or circumstances beyond the Seller's reasonable control.
Risk of loss passes to the Customer upon delivery of the Goods.
For orders shipped outside the European Union, the Customer is responsible for any customs duties, import taxes or similar charges imposed by local authorities.
RIGHT OF WITHDRAWAL (EU CONSUMERS)
Consumers located in the European Union have the right to withdraw from a distance contract within 14 days of receiving the Goods without giving any reason.
To exercise the right of withdrawal, the Consumer may:
• use the withdrawal functionality provided through their customer account or order-related communications where available;
• submit the withdrawal form available on the Store;
• contact us at contact@stanissed.art.
After notifying the Seller of withdrawal, the Consumer has an additional 14 days to return the Goods.
The Consumer bears the direct cost of returning the Goods unless otherwise required by law.
The Seller will reimburse all payments received from the Consumer, including standard delivery costs, no later than 14 days after receiving the withdrawal notice.
Additional costs resulting from the Consumer's choice of a delivery method other than the least expensive standard delivery option offered by the Seller will not be reimbursed.
The Seller may withhold reimbursement until the Goods have been received or until proof of return has been provided, whichever occurs first.
The Consumer is responsible for any diminished value resulting from handling the Goods beyond what is necessary to establish their nature, characteristics and functioning.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply where excluded by applicable law, including:
• custom-made or personalized products;
• products manufactured according to the Consumer's specifications;
• sealed goods not suitable for return for health or hygiene reasons once unsealed;
• other products exempt under Article 38 of the Polish Consumer Rights Act or equivalent applicable legislation.
DEFECTIVE GOODS AND LEGAL GUARANTEES
Consumers are entitled to statutory remedies in the event that Goods are not in conformity with the contract.
If a product is defective, damaged, incomplete or otherwise non-compliant, the Customer may contact:
The Seller will respond to complaints within 14 days where required by law.
Nothing in these Terms limits any mandatory consumer rights provided by applicable law.
RETURNS
Customers wishing to return Goods should contact contact@stanissed.art for return instructions.
A return authorization number may be provided to facilitate processing but is not required to exercise statutory consumer rights.
Returned Goods should be packaged appropriately to prevent damage during transport.

INTELLECTUAL PROPERTY
All content available through the Store, including text, graphics, logos, images, product designs, trademarks and other materials, is owned by the Seller or its licensors and is protected by applicable intellectual property laws.
No content may be copied, reproduced or distributed without prior written permission.
LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.
To the maximum extent permitted by law, the Seller shall not be liable for indirect, incidental, consequential or special damages arising from use of the Store.
PRIVACY
Personal data is processed in accordance with the Privacy Policy available on the Store.
Customers should review the Privacy Policy to understand how personal data is collected, used and protected.
CHANGES TO THESE TERMS
The Seller may amend these Terms where required by:
• changes in law;
• regulatory requirements;
• security reasons;
• technical changes;
• changes to Store functionality.
Updated Terms will be published on the Store together with a revised effective date.
DISPUTE RESOLUTION
Customers may contact the Seller at contact@stanissed.art regarding any concerns or disputes.
Consumers may also use any available out-of-court complaint and redress mechanisms provided under applicable law.
Nothing in these Terms limits a Consumer's right to bring claims before courts having jurisdiction under applicable consumer protection laws.
GOVERNING LAW
These Terms shall be governed by Polish law.
For Consumers residing in the European Union, mandatory consumer protection provisions of their country of residence remain unaffected.
