STANISSED Store Terms and Conditions

General provisions
1.These Regulations are the ones referred to in Article 8 of the Act of July 18, 2002 on electronic service provision (Journal of Laws No. 144, item 1204, as amended).
2.These Regulations establish the terms and conditions under which Users may access and use the online store located at the domain name www.stanissed.art (hereinafter referred to as: STANISSED or the STANISSED online store).
3.Registration and use of the STANISSED online store are conditioned on your acceptance of these Regulations. Each STANISSED Customer certifies that he or she has read the contract's contents prior to signing.

Definitions
1.Personal data administrator - Bartosz Rusin Tecnofabs, ul. Józefa Sarego 26/P1, 31-047 Kraków, Poland, NIP: 6792875696;
2.Cookies - small text files created by the User's web browser to assist the program in its operation;
3.STANISSED is a retail sales system in the form of an online store located at www.stanissed.art. It is owned by Bartosz Rusin and is located at Józefa Sarego 26/P1, 31-047 Kraków, Poland. It enables the submission and acceptance of orders for jewelry and other goods.
4.Password - a unique sequence of characters (numbers or letters) selected by the Customer and entered into the STANISSED online store system to verify his identity.
5.Consumer - a natural person who accesses the online store STANISSED, including those who make purchases, for purposes unrelated to their business or professional activity (in accordance with Article 22 1 of the Act of 23 April 1964 - Civil Code).
6.Customer or user - a legal person, an organizational unit that is not a legal person but has been granted legal capacity by the law, or a natural person who is not a consumer within the meaning of the Civil Code, including a natural person who enters into a sales contract with STANISSED that is directly related to its business and demonstrates that the contract lacks a professional nature for it.
7.Customer ID - Login to the STANISSED online store.
8.Goods - a tangible item or right that may be sold through the STANISSED marketplace.
9.User - any individual who accesses the STANISSED online sales system.
10.Order - an order for goods / goods placed in the STANISSED system by a registered Customer.

Registration
1.By registering with the STANISSED online store, the Customer is able to:
1.entering, editing, or deleting data, including delivery addresses;
2.placing orders using the customer's data;
3.creating a shopping list; 4. viewing order history; and
4.utilizing other registered customer-only features.
1.To register in the STANISSED online store (create a Customer account), you must fill out the online registration form, providing your name and surname, e-mail address, and mailing address, and, if registering a company account, company data (company name, company address, tax identification number). The customer is required to read these Regulations prior to placing the first order.
2.After the Customer completes and submits the registration form, STANISSED sends a confirmation of registration along with the Customer's initial account access password to the e-mail address provided. The registration process is now complete. After logging in for the first time, the customer has the option of changing the account's default password.
3.Registration in the STANISSED online store, as well as use of the STANISSED online store's functionality, are both free. Registration entails the Customer and STANISSED agreeing to the terms of a contract for the provision of electronic services consisting in the maintenance of the Customer's account.
4.After registering in the STANISSED online store, each login is made using the information entered in the registration form or as modified in the Customer's account settings.
5.The Client's account created as a result of registration is retained indefinitely. The customer may cancel their subscription to the STANISSED online store and request that their account be deleted at any time. There are no fees associated with account cancellation or deletion.
6.Each STANISSED Customer may terminate his or her account at any time by sending an e-mail to the following address: "Please terminate my account: ; A message requesting the deletion of the account should be sent from the address associated with the registered customer's account. All emails requesting the deletion of a Customer's account should be sent to contact@stanissed.art.com. Account deletion occurs immediately and signifies that the Customer has terminated the contract with STANISSED for the provision of electronic services with the purpose of retaining the Customer's account.

Rules for using the STANISSED online store
1.All users of the Internet network are eligible to use the STANISSED online store's services, provided they complete the registration process on the website www.stanissed.art and their ICT system meets the following minimum technical requirements: a) Internet access; b) a fast, broadband internet browser; and c) an active e-mail account.
1.Orders can be placed in the STANISSED online store 24 hours a day, 365 days a year, except when the website is unavailable for maintenance or other technical reasons. Orders are processed during normal business hours.
2.The customer of the STANISSED online store is required to use the STANISSED online store's services in a manner consistent with applicable law, these Regulations, and social coexistence and moral principles.
4.The customer of the STANISSED online store may not: a) use the STANISSED online store for purposes unrelated to its nature and subject matter; b) promote other websites by including links to other online stores on the STANISSED website; or c) advertise or promote their own activities.
1.The Customer is responsible for maintaining the confidentiality of his login and password for his account in the STANISSED online store. Within the bounds of generally applicable law, the Customer is solely responsible for all activities associated with the use of the login and password associated with a particular account in the STANISSED online store, and the password is confidential information for the Customer's sole use.

Personal data
1. Personal data provided by customers in the STANISSED online store (including during the account registration process, during the course of using the STANISSED online store, and during the course of making purchases in the STANISSED online store) is processed by Bartosz Rusin Tecnofabs, ul. Józefa Sarego 26/P1,
31-047 Kraków, Poland, NIP: 6792875696. (personal data administrator).
2.While providing personal data is voluntary on the part of the Customer, it is required in order to make purchases and use STANISSED's electronic services that require personal data. STANISSED processes personal data in order to provide electronic services, to enter into and perform contracts with the Customer for the sale of products ordered through the STANISSED online store.
3.The customer has the right to access, correct, and delete their personal data. After logging into the Customer's account, personal data may be corrected or deleted. By submitting the data, the customer certifies that the personal data is his.
4.Detailed provisions governing the protection of the Customer's personal data can be found under the Privacy Policy tab on the STANISSED online store's website.

Details of the Goods
1.STANISSED stipulates that due to the unique nature of the goods offered by STANISSED, the photographs of the goods displayed on the STANISSED website may slightly differ from the actual appearance of the goods.
2.The dimensions of products offered by STANISSED, such as their length, width, diameters, or holes, are indicative and may vary slightly from the actual dimensions of the products described by about 5% (say: 5%), due to the products' uniqueness and small size.
3.STANISSED's goods are intended for external use only and are only to be used for the purposes for which they were created. STANISSED shall not be liable for the use of the offered goods for purposes other than those for which they were intended.

Prices and Taxes
1.STANISSED's prices are gross prices, which include all applicable taxes.
2.The price of the purchase made in STANISSED that binds the Customer is the price of the goods provided at the time the Customer expresses his or her willingness to be bound by the contract on the STANISSED online store website, increased by the cost of shipping the goods to the Customer's specified address.

Order fulfillment
1.Order execution begins when STANISSED receives payment in the amount of 100% of the order price.
2.Following receipt of payment for the order, STANISSED will provide the Customer with an appropriate sales document in the form required by law.

Order confirmation
1.Placing an order constitutes the Customer's submission of an offer to purchase the Goods.
2.After placing the order, STANISSED sends it to the e-mail address provided by the Customer - information confirming the order's registration, which serves as STANISSED's declaration of acceptance of the Customer's offer.
3.STANISSED provides clear and legible information on the method of delivery of the Goods and the accepted methods of payment on its website.
4.At the latest when the Customer expresses a desire to be bound by the contract with STANISSED via clear and understandable information placed on the online store's website, STANISSED fulfills information obligations, including those set forth in Art. 12 of the Act of May 30, 2014 on consumer rights, and in particular information on the primary features of the STANISSED service: the STANISSED designation, the total price for the Goods including taxes, the method of communication with the customer, as well as fees for transport, delivery, courier services.
5.STANISSED ensures that the Customer clearly confirms, at the time of placing the order, that he/she is aware that the order entails a payment obligation, by clicking the "Confirm order with payment obligation" button.
6.The customer agrees that STANISSED may send VAT invoices and corrective invoices via e-mail to the e-mail address provided when placing the order, without the issuer's signature. STANISSED will issue, send, and archive VAT invoices and corrective invoices in accordance with the law, with a particular emphasis on maintaining their integrity and authenticity.
7.If STANISSED is unable to perform the service due to the subject of the service being unavailable, it notifies the Customer via the e-mail address provided when placing the order and promptly returns any payments made, but no later than 14 days from the contract's conclusion in the case of advance payments.

Shipment of the Goods, Order Processing Time
1.The standard shipping procedure for an order entails a single collective shipment of all goods ordered by the Customer in connection with that order.
2.The STANISSED system calculates the cost of delivery of the Goods to the Customer automatically, based on the shipping cost and the value of the Goods ordered.
3.Additionally, STANISSED informs Customers that if they place an order that is not standard (in terms of weight or dimensions of the Goods), it is possible to change the delivery price of the ordered Goods in comparison to the price automatically generated by the STANISSED store (when the actual cost of delivery of the Goods, as determined by the courier company's price list, is changed or charged differently than the price automatically generated by the STANISSED store). In such a case, STANISSED's representative will contact the Customer via e-mail to solicit acceptance of the revised delivery price for the ordered Goods.
4.After STANISSED ships the purchased goods, the Customer will receive an email confirming the order's details, including the type of Goods ordered, their price, and shipping costs. After STANISSED ships the Goods ordered by the Customer, the Customer will receive notification that the Goods have been delivered to the Customer's specified address.
5.The order fulfillment time period begins on the next business day after funds are credited to the STANISSED account and ends on the day the order is handed over to the courier.
6.Shipping time:
· shipping by UPS STANDARD courier - 1 - 3 days for EU, 4-7 days for NA, 4-10 days for Asia.
· shipment by UPS EXPRESS - 1 - 2 days for EU, 3-4 days for NA, 3-7 days for Asia.
· shipping by UPS WORLDWIDE courier - 3 - 15 days for other countries.
1.STANISSED notifies customers that during the holiday season (Easter, Christmas), as well as on Valentine's Day, Women's Day, and Black Friday (Black Friday), order fulfillment times may be extended due to the high volume of orders placed during these times.

Payment methods
The customer may pay for the Goods using the Stripe payment system, PayPal, by debit or credit card or Klarna.

Withdrawal from the contract
1.Subject to the provisions of subpara. 2, to the Customer who is a consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, who concluded a distance or off-premises sales contract with STANISSED, have the statutory right to withdraw from the contract within 14 days from the date of taking possession of the goods, without giving reasons and without incurring costs. In the event of withdrawal from a distance or off-premises contract, the contract is considered void.
2.To exercise the aforementioned rights, the consumer or natural person concluding a sales contract with STANISSED directly related to its business activity may do so if the content of the contract demonstrates that it does not have a professional nature for it, resulting in particular from the subject of the business activity performed by that person, disclosed in accordance with the Centennial provisions. The client submits to STANISSED a declaration of withdrawal from the contract, a model of which is attached as Annex 1 to the Regulations.
1.In the event of withdrawal from the contract in the manner specified in § 12 sec. 1 of the Regulations, a consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, when the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject performed by that person business activity, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, is obliged to return the completed Annex 1, the goods intact and the purchase document, and in the absence of another document confirming the transaction in the STANISSED store to the following address: ul. Józefa Sarego 26/P1, 31-047 Kraków, Poland.
1.The right to withdraw from the contract is not granted to the consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject performed by this contract. business person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, in the cases specified in detail in art. 38 of the Act of May 30, 2014 on consumer rights, including in the case when the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy his individual needs.
1.STANISSED returns the Consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, all payments made by the above-mentioned persons no later than within 14 days from the date of receipt of the consumer's or natural person's declaration, concluding a sales contract with STANISSED directly related to its business, if the content of this contract shows that it is not of a professional nature , resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity on withdrawal from the contract.
2.A consumer or natural person who enters into a sales contract with STANISSED that is directly related to its business activity, if the content of the contract demonstrates that it does not have a professional nature for it, resulting in particular from the subject of the business activity performed by that person, as disclosed under the provisions on Central Register and Economic Activity Information, when exercising the statutory right to withdraw from the contract, bears only the direct costs of returning the items to STANISSED.
1.STANISSED may withhold the reimbursement of payments received by the consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the contract. by that person of economic activity, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity until the goods are returned or the above-mentioned person provides proof of its return, depending on which event occurs first.
2.STANISSED shall refund the amount due for the returned Goods based on the content of the document confirming the purchase of the Goods from STANISSED.
3.A consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, when the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the activity performed by that person economic, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, is responsible for the reduction in the value of the Goods as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

Complaints
1.STANISSED is responsible for the consumer and the natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on the Central Records and Information on Economic Activity, for defects in the Goods based on the warranty on the terms set out in the provisions of the Civil Code.
2.Complaints about Goods ordered in the STANISSED online store should be submitted to the email address: contact@stanissed.art
3.A complaint may be submitted using the form found on the online store's website: Form - Complaint. To begin, the customer should send a photograph of the advertised product, along with a description of the defect, to the e-mail address specified above. Subsequently, within 72 hours of receipt of the complaint, the Complaints Department will determine its legitimacy and notify the Client of the next steps. If the Complaint Department determines that the complaint is justified, it will notify the Customer via e-mail of the method and address for delivery of the advertised goods.
4.STANISSED will finally respond to the submitted complaints within 14 days from the date of their notification, as well as inform the Consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have professional nature, resulting in particular from the subject of the economic activity performed by that person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, on further procedure.
5.If the Product has a defect, the Consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the activity performed by that person economic, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, may be submitted a declaration of price reduction or withdrawal from the contract, unless STANISSED immediately and without undue inconvenience for the above-mentioned persons replaces the defective product with a product free from defects or removes the defect. This limitation does not apply if the Product has already been replaced or repaired by STANISSED or STANISSED did not satisfy the obligation to replace the Product with a non-defective one or remove the defect. The reduced price should be in such proportion to the price resulting from the contract in which the value of the defective Goods remains up to value of the Goods without defects. A consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on Central Register and Information on Economic Activity, may not withdraw from the contract if the defect is irrelevant.
6.A consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional character for it, resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of provisions on the Central Register and Information on Economic Activity, maybe instead of the one proposed by STANISSED to remove the defect, demand replacement of the Product with a non-defective one, or demand removal of the defect instead of replacing the Product, unless it is impossible to bring the Product to compliance with the contract in the manner chosen by the above-mentioned persons or would require excessive costs compared to the method proposed by STANISSED.
7.If the Product has a defect, the Consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, when the content of this contract shows that it does not have a professional nature for it, resulting in particular from the subject of the activity performed by that person economic, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity may request replacement of the Product with a Product free from defects or removal of the defect. STANISSED may refuse to satisfy the Consumer's request if it is impossible to bring the defective Goods into compliance with the contract in the manner chosen by the Consumer or would require excessive costs compared to the second possible way to bring them into compliance with the contract. STANISSED is liable under the warranty if a physical defect remains found before the expiry of two years.
8.A consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it does not have a professional nature for it resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, which exercises the rights under the warranty, is obliged to deliver the defective Goods to the address STANISSED. In the event of repairing the Goods or replacing them with a new one, STANISSED shall refund the necessary costs incurred by the above-mentioned persons, including the costs of delivering the Goods to STANISSED, immediately, but not later than within 14 calendar days of accepting the complaint. If the Goods are repaired or replaced, STANISSED shall reimburse the above-mentioned persons for all reasonable costs incurred, including the cost of delivering the Goods to STANISSED, immediately but no later than 14 calendar days after accepting the complaint.
9.In the event of submitting a declaration of withdrawal from the contract or price reduction, STANISSED returns the paid by the Consumer or a natural person concluding a sales contract with STANISSED directly related to its business activity, if the content of this contract shows that it is not of a professional nature for it. , resulting in particular from the subject of the business activity performed by that person, disclosed on the basis of the provisions on the Central Register and Information on Economic Activity, the selling price of the Goods, the costs of shipping the Goods to the above-mentioned person. costs of delivering the Goods to STANISSED and other justified and necessary costs related to the complaint immediately, but not later than within 14 calendar days from the acceptance of the complaint.
10.The payment is refunded using the same method of payment as used by the Customer, i.e. to the bank account from which the transfer for the Goods was made or to the bank account associated with the payment or credit card with which the payment for the Goods was made. If the Customer paid for the Goods in cash on delivery, the payment is refunded to the bank account number provided by the Customer using the e-mail form, which does not involve any costs for the Customer and requires the Customer's express consent. If the Customer paid cash on delivery for the Goods, the payment is refunded to the bank account number provided by the Customer via the e-mail form, which is free of charge to the Customer and does not require the Customer's express consent.
11.Complaints for non-performance or improper performance of electronic payment services made using a payment card or other payment instrument should be addressed to the issuing bank of your payment card - in accordance with the provisions of the Act of August 19, 2011 on payment services (Journal of Laws No. 199, item 1175 as amended) and the Act of 12 September 2002 on electronic payment instruments (Journal of Laws No. 169, item 1385 as amended).
12.Complaints regarding the provision of electronic services by STANISSED (in particular regarding technical issues and the functioning of the www.stanissed.art website may be submitted by e-mail to the following address: contact@stanissed.art with a detailed description of the technical problem.
13.STANISSED's liability towards the Customer who is not a Consumer under the warranty for physical and legal defects of the goods referred to in Art. 556 of the Civil Code - 576 of the Civil Code is excluded, and due to improper performance or non-performance of the contract, it is limited only to cases of willful STANISSED.
14.Complaints will be considered based on the content of the document confirming the purchase of goods from STANISSED.

Importance
If any provision of these Regulations is considered invalid by a valid court decision, the remaining provisions shall remain in force.

Governing Law
The law applicable to the contract between the Customer and STANISSED, which
the subject is the services provided by STANISSED under the conditions specified in the Regulations, is Polish law. By accepting the content of these Regulations, the Parties hereby choose the Polish law as the applicable law.

Final Provisions
1.STANISSED, for statistical purposes and in order to ensure the highest quality of services, uses information saved by the server on the Customer's end device, which is then read each time the web browser connects (so-called cookies). The customer may at any time specify the conditions for storing or accessing cookies by the STANISSED online store using the settings of his web browser, including changing the browser settings so that it does not accept such files or informs about their transmission. However, it should be remembered that not accepting cookies may cause difficulties in using the STANISSED Online Store. The use of a browser by the Customer, the settings of which allow cookies to be saved on the Customer's device, means consent to the saving of the above files on this Customer's device. More information in this regard can be found in the Privacy Policy.
2.STANISSED reserves the right to amend these regulations for an important reason, which is:
· the need to adapt the regulations to legal provisions that have a direct impact on these regulations and resulting in the need to modify the regulations in order to comply with the law;
· the necessity to adjust the regulations to the recommendations, orders, rulings, decisions, interpretations, guidelines or decisions of authorized public authorities;
· expansion or change of the functionality of the STANISSED online store, including the introduction of new services provided electronically or changing the existing functionalities of the STANISSED online store;
· change of technical conditions for the provision of electronic services;
· the need to remove any ambiguities, errors or typographical errors that could possibly appear in the regulations;
· change of contact details, names, identification numbers, electronic addresses or links contained in the regulations;
· counteracting abuses;
· improving customer service;
· changing the contract conclusion process via the STANISSED online store.
1.The changed Regulations will be made available in the STANISSED online store. STANISSED will inform about the change of these Regulations by sending to the e-mail address assigned to their account notifications about the change in the regulations.
2.The amended Regulations are binding for the Customer who does not terminate the account agreement in the STANISSED online store (will not resign from the account under the terms of § 3 section 7 of these Regulations) before the effective date of the amended Regulations.
3.Amendments to the Regulations will not affect orders placed before such a change, which are implemented on the basis of the existing rules.
4.These Regulations are valid from 1st of March 2022.
5.Any disputes that may arise from the Client's cooperation with STANISSED, relating to the provision of services by STANISSED, which cannot be prevented by the complaint procedure, shall be settled by the common court competent for the seat of STANISSED. The above indication of the local property
The court does not apply to customers of STANISSED who are consumers, for whom the competent court will be the competent Polish common court.
1.In matters not covered by these Regulations, the relevant provisions of the Civil Code and other applicable laws shall apply.

Terms and Conditions for Gift Cards
1.Definitions
·Gift Card: An electronic payment instrument with a specified monetary value, valid exclusively on STANISSED’s website;
·Cardholder: The individual who has purchased or received the gift card and is entitled to use it under these terms and conditions.
2.Scope of Use
·The gift card can only be redeemed for purchasing products on STANISSED’s website;
·The card is not redeemable for cash unless required by applicable law;
·The gift card cannot be used to purchase other gift cards.
3.Card Validity
·The gift card is valid for 12 months from the date of purchase unless otherwise required by local laws;
·After the expiration date, the card will no longer be valid and cannot be used.
4.Balance and Usage:
·The card balance can be checked by logging into your account on STANISSED’s website or by contacting customer support;
·The gift card can be used for full or partial payments. If the purchase amount exceeds the card balance, the difference must be paid using another payment method;
·Refunds for products purchased with a gift card will be returned to the gift card.
5.Restrictions:
·STANISSED is not responsible for lost or stolen gift cards, and any remaining balance cannot be replaced;
·The gift card must not be used in violation of the store’s Terms of Service.
6.Complaints:
·Any complaints related to gift cards should be directed to contact@stanissed.art;
·Complaints will be handled in accordance with applicable laws and the store’s Terms and Conditions.

8.Amendments to the Terms:
·STANISSED reserves the right to amend these terms and conditions. Any changes will be announced on the website.
